A. TO WHOM IS THIS WARRANTY ISSUED? The dealer offers and extends this limited warranty on mechanical defects on the components and parts described in “B” below to the original purchaser only and applies only with respect to the motor vehicle described herein (the subject vehicle). This limited vehicle warranty is non-transferable or inherited. B. WHAT PARTS OF THE VEHICLE ARE COVERED BY THE LIMITED WARRANTY? The coverage of this warranty shall be limited to the covered components and parts thereof as listed below: ENGINE: All internal lubricated parts, including: pistons, piston rings, piston pins, crankshaft and main bearings, connecting rods and rod | bearings, camshaft and camshaft bearings, timing chain or timing gears, intake and exhaust valves, intake manifold, valve springs, guides, oil pump, push rods, rocker arms, hydraulic lifters, rocker arm shafts, cylinder heads...The engine block is covered if mechanical failure was caused | by the above listed parts, excludes seals and gaskets. AUTOMATIC OR STANDARD TRANSMISSION: All internally lubricated parts contained within the transmission case and/or torque converter case, transmission case and torque converter case if damaged by the failure of an internally lubricated part. Does not include the clutch assembly, cluich pressure plates, flywheel, throwout bearing, seals and gaskets. DRIVE AXLE ASSEMBLY: All internally lubricated parts contained within the drive axle housing. Drive axle housing if damaged by failure of any internally lubricated parts. Excludes drive shaft and universal joints, including constant velocity joints and assemblies, seals and gaskets. C. WHAT IS NOT COVERED BY THE LIMITED WARRANTY? Malfunctions resulting from collision, vandalism, neglect, improper maintenance, excessive abuse, falling missiles or objects, fire, theft, larceny, explosion, lightening, earthquake, windstorm, hail, water, flood, malicious mischief, riot or civil commotion. The replacement of maintenance items (such as spark plugs, ignition points, positive crankcase ventilator valve, filters, lubricants and oil, brake and clutch linings, electrical items) made in connection with normal maintenance services. Any other repairs to parts of the vehicle not specifically indicated under sections (b) and (c) in this limited warranty, including seals and gaskets. D. WHAT PERCENTAGE OF THE REPAIR CHARGES ARE COVERED? All repair costs arising out of this limited warranty are subject to a deductible of $100.00 per repair, which is and shall remain the responsibility of the purchaser, and shall be paid in cash in advance of any repairs to the subject vehicle. Thereafter, 100% of the total charges (parts and labor) for the repairs covered under Section B above shall be the responsibility of the dealer, subject to the terms and conditions of this limited vehicle warranty. E. HOW LONG DOES LIMITED WARRANTY RUN? This limited warranty shall expire immediately upon Purchaser's transfer of ownership of the vehicle. For the purposes herein, transfer of the ownership occurs at any time that the Purchaser identified herein is no longer the owner of the subject vehicle, regardless of whether said transfer has been reported to the Department of Motor Vehicles by the Purchaser. F. WHAT IS THE VEHICLE OWNER’S OBLIGATION? During the term of this limited warranty, as addressed in Section E hereof, Purchaser shall be obligated to perform the following maintenance on the subject vehicle, to-wit: (1) Purchaser shall follow the Nissan Maintenance Schedule (“One”) as outlined by the Nissan Maintenance Manual on the subject vehicle; and; (2) To perform transmission service every two (2) years or 30,000 miles, whichever occurs first. Purchaser is obligated and must insure that the maintenance required in Section F has been performed in accordance with the terms of this section and in accordance with the Nissan Maintenance Schedule by reputable mechanics properly trained and is performed properly without defect and without causing damage to any item covered under this limited vehicle warranty. Purchaser will be required to show proof that the maintenance required under this limited warranty has been completed. Should purchaser choose to perform the maintenance required in Section F by a service center other than Nissan of Omaha, purchaser will be required to have the vehicle inspected every 24 months at no charge by Nissan of Omaha and show proof, acceptable to warrantor, that the required maintenance has been completed. All warranty repairs as addressed in Section B above shall be performed by Dealer at Nissan of Omaha located in Omaha, Nebraska. Failure on part of purchaser to comply with the foregoing terms and conditions of this limited vehicle warranty shall result in this limited vehicle warranty being voided. At that time, Dealer shall have no further obligation to Customer herein. Purchaser's obligation to maintain the subject vehicle as addressed in this Section F shall begin immediately upon Purchaser taking possession of the subject vehicle. G. WHAT IS THE SELLING DEALER’S OBLIGATION? During the limited warranty period the dealer will start all repairs under their limited warranty within 48 hours after delivery of the vehicle to the dealer’s address shown above. During the limited warranty period described in Section F, the dealer will repair any part or parts listed in Section B, upon authorization by the purchasers payment of the deductible stated in Section D above. H. LIMITATION ON IMPLIED WARRANTIES, CONSEQUENTIAL AND INCIDENTAL DAMAGES. ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY LIMITED TO THE SAME DURATION OF TIME AS THE EXPRESS WRITTEN WARRANTY ABOVE STATED. THIS LIMITATION DOES NOT APPLY IF A VEHICLE SERVICE CONTRACT IS PURCHASED AT THE TIME OF SALE OR WITHIN 90 DAYS OF SALE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. BUYER SHALL NOT BE ENTITLED TO RECOVER FROM THE SELLING DEALER ANY CONSEQUENTIAL DAMAGES, DAMAGES TO PROPERTY, DAMAGES FOR LOSS OF USE, LOSS OF TIME, LOSS OF PROFITS, OR INCOME, OR ANY OTHER INCIDENTAL DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. PURCHASER’S LEGAL RIGHTS. This warranty gives you specific legal rights. You may choose to consult with an attorney at law to learn of any additional rights you may have with regard to this limited vehicle warranty. J. REPLACEMENT PARTS. Dealer has the option at its sole discretion to perform the repair to any parts listed in Section B with used, rebuilt, remanufactured or new replacement parts.
